Los Angeles, CA (CNS) - Comic Robert Schimmel's domestic violence suit has been dropped. The X-rated comedian's wife has declined to press charges against him.
Schimmel, 59, was arrested in the early morning hours of May 2 following an argument with his wife, Melissa. Police booked him for spousal assault and held him on $50,000 bail.
According to the document filed by the Los Angeles County D.A., there was insufficient evidence to move forward with the case and that Melissa "indicated she did not want charges filed."
A rep for the funnyman told TMZ, "We are very gratified the D.A. reviewed the case and determined that the filing of criminal charges is not warranted."
Melissa, however, filed divorce papers less than a week after the incident. She's asking for spousal support and sole physical custody of their two minor children, as well as child support.
